Terms and Conditions of the Hire of Backcloths

Introduction
This document sets out the terms of hire and the responsibilities of all parties involved in the hire of back cloths from Thoroughly Theatre Ltd.

1. Period of Hire
The dates that the backcloths leave our store to the date the backcloths return to our store.

2. A Contract
This will exist only after the required booking confirmation has been received via our website system. This contract will be between the individual (s) name entered on the form (jointly and severally) and Thoroughly Theatre Ltd.

3. Insurance
It is a condition of hire that the Backcloths are insured by the hirer during the period of hire. This includes whilst in transport, If arranged by yourselves, by the hirers direct, and/or at the venue where the production is staged, or any intermediary store, for its full replacement value.

4. Transport
The carriage of all backcloths is by a designated courier service and will be delivered and collected at times that has been arranged with yourselves. The courier service may call you before hand and you must be available at the appropriate times for delivery/collection or you will occur additional costs if not collected. You must phone the office if you have a collection that is due that for any reason has not been collected.

5. No responsibility
will be taken, or claims entertained for shortages, or any items received damaged unless reported to us by, or on the first day of the time of the hire.

6. Fit for Purpose
It is the responsibility of the hirer to ensure that goods are ‘fit for purpose’. Hired backcloths are only to be used for ‘as originally designed.’

7. Damage
All damages and losses other than normal wear and tear whilst on hire will be charged to the hirers, regardless of the cause of the damage. Back cloths must be hung in an appropriate manner and kept clean and dry.

8. Fire
If back cloths are returned with any fire damage or burn holes in they will be charged for and may possibly result in a whole cloth having to be repainted.
Be aware that our cloths are fire retardant but if they are hung too close to a light source it is very dangerous. Failure of the hirer to comply with this requirement will leave the hirer responsible for any damage caused.

9. Substitutions.
Thoroughly Theatre ltd reserves the right to make any substitutions that may be deemed necessary due to late or non-return, or damage, by a previous hirer or circumstances beyond their control. Where possible, notice of such will be given.

10. Cancellation
If the hirer wishes to cancel a confirmed booking, the contractors will make every attempt to re-hire the backcloth to another organisation for the contract dates. Should this not be possible the hire charge (less a deduction in respect of reduced handling costs) will be payable. If a booing is cancelled within 14 days of the start of the hire, a 100% cancellation fee will be charged (this does no effect the Covid guarantee, if Coivd restrictions are the reasoning why the booking has to be cancelled, the dates can be changed at no extra cost)

11. Backcloths
All hires are to be paid for prior to dispatch/collection. They must be re-folded and replaced in their correctly numbered bags for return. A re-folding charge will be made for any cloths returned in the wrong bags or incorrectly folded. Backcloths must be hung in a suitable manner, must not be walked on and must not come in contact with any liquid.

12. Return of Hired Items.
The hirer is responsible for ensuring that all the hired items are returned appropriately to our stores. Where we arrange transport, the hirer ensuring that all the items are loaded onto the vehicle for the return will discharge the responsibility.

13. Force Majeure
Whilst every endeavour is made to fulfil all contracts promptly and efficiently, no responsibility can be accepted or allowances entertained, in respect of circumstances beyond our control.

14. Payment Terms
All costs for hire of backcloths must be paid in full before any item leaves our warehouse.

15. Risk Assessment/Health and Safety
Any risk assessment is the responsibility of the hirer. Please contact us if there are any Health and Safety issues regarding the hire, before any action is taken.
